Cancelation of Instruments under section 39 of Specific. Relief Actt,1877 mention the provision as Where any registered deed is Fradulent or falsely made, void or voidable in the eye of law and is harmfull top the parties. If it is like that must have to file suit for cancellation of instruments .
In this regards cause of action is to arise from the date of knowledge of the disputed instruments. After arising cause of action . suit for cancellation of instrument can file in the competent court .
Elements of Suit for cancellation of instruments:
- The deed must be written and registered
- The deed is made falsely or fabricated ,
- The deed is void and voidable in the eye law
- And finally it is harmful for the parties and next generation.
Limitation peried of filing this suit :
Limitation peried to file this suit is to calculate from the date of knowledging and knowing about the disputed instruments. The perieod is 3 years, it menttion in the 1st schedule of Limitation Act,1908, Article 91.
Suit valution of the cancellation of instruments:
The pecuniary jurisdict or the valuation the suit is the same as mention in the disputed deeds. And accordingly advelurem court fees is to pay .
The deeds when unregistered :
In this regards ,if this deed is made of unregister ,suit for cancellation of instruments will not lie. in that case ,suit for declaration is lie . It means this disputed deed is not binding upon the plaintiffs or not forceable by way law . To do this advelurem court fees is not necessary. Only fixed court fee is to pay in filing the suit for declaration .
The court is not bound to cancell the disputed instruments. It is not mandatory to pass a judgment and decree by the trial court, rather it is directive to pass a judgment and decree.
In conclusion :
The provision of section 39 is, “When registered instruments is false or fabricated, void or voidable or harmful to the parties , the plaintiff can file suit for cancellation of instruments. And the courts with his inherent power may cancell the instruments. “
